Reschedule and Cancellation Policy:
We cannot guarantee the availability of workshops to reschedule a workshop session. If you would like to reschedule a workshop session, please reach out to Sam at sf*************@**************ng.com at least 1 week in advance of your scheduled workshop time. No refunds will be given in the case that we are unable to reschedule a workshop.
Confidentiality Policy:
All of your Student’s interactions with us are confidential, including appointments, scheduling, attendance, session content, progress, and records. We will not share mentoring records with any school, employer, or other third party except upon written request from a legal parent or guardian.
Limits on Confidentiality:
If we or a Mentor receives information that a Student may be a danger to themselves or others, necessary steps must be taken to protect them. If we believe there is evidence of clear and imminent danger or harm to the Student or to others, we will report this information to authorities necessary to protect the appropriate party.
- If we learn of, or strongly suspect, physical or sexual abuse, or neglect, of any person under 18 years of age, we will report this information to the appropriate authorities.
- If we receive a court order or subpoena addressed to us, we will respond and may disclose confidential information as required by law.
- In any other situation where we are bound by law to reveal any confidential information or otherwise report to authorities, we will follow the law in doing so.
ASSUMPTION OF RISK, WAIVER AND RELEASE:
I understand that as part of the executive function mentoring services provided by Untapped Learning (“Untapped”), my child will engage in activities that involve high intensity movement, which may include but are not limited to soccer, football, and Spikeball (the “activities”). I recognize that these activities can involve the risk of injury and/or exposure to illness.
In consideration for participation in Untapped’s programs, I AGREE TO EXPRESSLY ASSUME ALL RISKS OF INJURY and EXPOSURE TO ILLNESS that might be associated with the activities, and, to the fullest extent permitted by Colorado Law, I HEREBY WAIVE AND RELEASE FROM LIABILITY Untapped, Brandon Slade and their/his partners, employees, agents and volunteers (collectively, the “Parties”) from any damage or injury arising from my child’s participation in the activities.
I understand that this release and waiver prevents me, or anyone acting on my behalf, from filing suit or making any claim for damages in the event of injury or illness arising out of my child’s participation in the activities. However, in the event that any person acting on my behalf files a lawsuit arising out of my child’s participation in the activities, I AGREE TO DEFEND, INDEMNIFY AND HOLD HARMLESS the Parties for any damages, attorney’s fees or costs associated with or arising out of such lawsuit.
Public Health and Safety:
In the event of a public health crisis, Untapped Learning will adhere to all local, state, and federal guidelines and mandates. Students, parents, and Mentors who enter the building will be expected to follow those rules and regulations, and those rules and regulations are subject to change without notice. If we are forced to close a center due to public health concerns, we will switch to a virtual format.
We respect the personal health concerns of our Students and our staff. We will remain open for in-person sessions as long as it is safe to do so. If at any point you, your Student, or your Student’s Mentor feel uncomfortable continuing with in-person sessions, virtual options may be arranged.
Media Release:
Untapped Learning and their designees have the right and permission to:
- Reproduce, use, re-use, publish, display, copyright, and distribute all media taken in which your student might appear and in connection with any and all media now known or hereinafter developed, for all purposes and in perpetuity.
- Reproduce, use, re-use, publish, display, copyright, and distribute the same, individually or in conjunction with other photographs, images, text, and/or captions in connection with any promotion, advertising, and publicity of Untapped Learning in all media for all purposes and in perpetuity.
By participating in a program at Untapped Learning, I understand that I am agreeing to this media release, and that I may revoke this right and permission through written communication to Untapped (delivered by US Mail or emailed to Karen Wilkinson at kw********@**************ng.com). Untapped Learning is released and discharged from any and all claims, demands, and liability in connection with the use of such media in connection with Untapped Learning.
Data Release and Consent:
During your Student’s participation in the program your Student may have the opportunity to participate in research activities conducted by Untapped Learning. Your Student’s participation is completely voluntary, and if you agree to let your child participate now, you can always opt out later. Your Student will not receive additional benefits for participation or be penalized if you Student does not participate in these optional research activities.
Our research activities involve the use of surveys administered to students, parents, and/or mentors that are intended to enhance our understanding of your Student’s EF baseline and improvement throughout your Student’s time with us. You or your Student can choose not to participate in any survey at any time, however option out during the course of a research activity may exclude your Student from the study and its findings.
Untapped Learning may use the results and findings from our research activities for a variety of purposes, however they will not be used in any way that would reveal Personal Identifiable Information (PII) to outside parties, unless Untapped Learning is legally required to do so in connection with law enforcement investigations or other legal proceedings. Personal Identifiable Information (PII) is defined as: any representation of information that permits the identity of an individual to whom the information applies to be reasonably inferred by either direct or indirect means.
For example, as Untapped Learning is a unique program we may publish our findings in academic journals for the benefit of other educators and program developers. If we choose to publish a study, all PII will be removed and replaced with an anonymous study ID. Additionally, the anonymized data may be sent to an institutional review board to ensure our research methods remain current and safe for students. It also may be shared with other researchers, again with PII removed and replaced with an anonymous study ID. Further, the results and findings from our research activities may be used for our own marketing and promotional materials.
Recording and Transcription Acknowledgement:
Untapped Learning and their designees have the right and permission to record, transcribe, and use video and/or audio from any mentoring sessions in which your student may participate for the purposes of training, quality assurance, research, educational assessment, and program improvement.
By acknowledging, I understand that these recordings and transcripts may be used for internal purposes and will not be shared with third parties or used for external promotional purposes without additional written consent. I also understand that any research use of the data will comply with standard anonymization, confidentiality and security practices.
Program Termination Policy:
No refunds will be granted for summer workshops or sessions.
